BMV Hearing: What is the purpose?

If you have been criminally charged with a DUI, it is very important that you realize that you will be facing not one, but two separate court hearings. Following a DUI arrest, this will immediately trigger what is known as the Probationary License Suspension that stems from drunk driving. This, however, is not an immediate or a certainty. You will have 30 days of the mailing date that you received the notice to request a hearing with the Ohio Bureau of Motor Vehicles.

This hearing, commonly referred to as the BMV hearing, differs from the criminal case in that it will not directly deal with the aspect of your guilt. Instead, it will deal with the suspension of your driving privileges. You do not personally need to be present at this hearing; it is perfectly legal to be represented by your Dayton criminal defense attorney at this point in time.
