			<description>&lt;p&gt;On December 20 in Dayton, Ohio a woman was arrested for abusing the 911 emergency call system, as well as being found in possession of the illegal drug marijuana and drug paraphernalia.&lt;/p&gt;

			<description>&lt;p&gt;Carl Ward Jr. was arrested Sunday, December 19 after attempting to evade police officers who pulled him over on North Orchard Avenue.&lt;/p&gt; 
&lt;p&gt;Police officers in Dayton, Ohio said they attempted to pull Ward over, who proceeded to exit his vehicle and attempt to escape on foot.&lt;/p&gt; 
&lt;p&gt;He was chased and found hiding nearby in the snow. When the officers tried to handcuff him, Ward attacked one of the officers, placing them in a choke hold. The officer broke free at which point Ward was promptly arrested. &lt;/p&gt;

	&lt;span&gt;a defendant was resentenced after appellate remand. &amp;nbsp;&amp;nbsp;In 2000, the&amp;nbsp;&lt;/span&gt;
	&lt;span&gt;Commission resolved the split by promulgating USSG 5K2.19, which states&amp;nbsp;&lt;/span&gt;
	&lt;span&gt;that post-sentencing rehabilitation is not an appropriate basis for&amp;nbsp;&lt;/span&gt;
	&lt;span&gt;downward departure.&lt;/span&gt;

&lt;div&gt;

		&lt;span&gt;post-sentencing rehabilitation for purposes of a downward variance), and&amp;nbsp;&lt;/span&gt;
		&lt;span&gt;&lt;i&gt;United States v. Lorenzo&lt;/i&gt;, 471 F.3d 1219 (11th Cir. 2006) (holding that&amp;nbsp;&lt;/span&gt;
		&lt;span&gt;district courts are precluded from considering post-sentencing conduct&amp;nbsp;&lt;/span&gt;
		&lt;span&gt;under § 3553(a),, though it has recently recognized that &quot;there is a&amp;nbsp;&lt;/span&gt;
		&lt;span&gt;question as to whether Lorenzo continues to be good law in light of&amp;nbsp;&lt;/span&gt;
		&lt;span&gt;[Booker, Rita, Kimbrough, Gall, and Spears],&quot; see &lt;i&gt;United States v. Smith&lt;/i&gt;,&amp;nbsp;&lt;/span&gt;

		&lt;span&gt;Circuit affirmed.&lt;/span&gt;
